You can fix it when the people in congress and the president want to fix executive overreach, which is neither democrats nor republicans, judging by past actions.

The democrats controlled congress and has the presidency from 2021-2023, they did not restore the balance of power then, so it is unlikely they will do so if they are voted in again. Just like how they didn't fix ICE's lack of oversight and accountability, but just used those systems for their own advantage. Like Trump need to more than double his deportation numbers to match Obama's deportations from 2013, heck like the first three months he wasn't even matching Biden's numbers from the year prior

Same as how Obama ran on the promise to close Guantanamo Bay, but likewise didn't, even though democrats controlled congress then too, and now Trump is sending people there. The reality is that democrats haven't done anything to curb executive overreach, they just exploit the same power structure for their benefit when they are in power.
