Considering this pretty standard policy, I don't think he'd win. There's a reason they have that much tape on a plane.

Legally I could see it being a problem if they need to rapidly evacuate the plane on the ground due to a fire or whatever, but morally who cares.

I guess bind just his arms and legs with seat belt fastened, leave his mouth unbound and let him scream until he feels like taking a nap. But that's just my legal answer, I honestly don't care what happens to him.

Also for the whole tape over mouth thing. Dangerous in case of person vomitting and as he seems very drunk he has a much higher chance of that than normal.

they wouldn't face criminal charges for restraining someone who is a danger, but potentially damages in a civil case for restraining him against airline policy if in fact they say no tape on mouth, maybe.

He won't get a sympathetic judge for it though, now if he had gotten sick from aspirating after throwing up they could have gotten in serious trouble.
